A. Motorcycle Brake Rotor Warranty:
All RayGun Technology™ motorcycle brake rotors (the “Rotors”), by Tech M3, Inc., a California corporation (the “Company”), when purchased together with, and installed and used concurrently with, RayGun Technology™ motorcycle brake pads, are warranted against defects in material and workmanship for as long as the end user/consumer of the Rotor and Brake Pads (“Purchaser”) owns the motorcycle on which the Rotor and Brake Pads are first installed, subject to the limitations herein contained.
***In the event the Purchaser elects to use another brand of brake pads then the rotor warranty is limited to one year or 10,000 miles whichever comes first.***
The sole and exclusive remedy of the Purchaser, or any third party, for any claim of any kind against the Company arising from or in connection with the purchase or use of the Rotor, including but not limited to claims in contract, warranty, negligence, or other tort, shall be, at the option of the Company, (i) a refund or credit of all or a portion of the price paid for the Rotor at issue, or (ii) repair or replacement of the Rotor, in each case, excluding all labor and ancillary charges, such as collection, shipping, fitting, installation, inconvenience, and purchasing of other products, subject to Purchaser’s fulfillment of the requirements set forth under “How to proceed with a warranty claim” below. EXCEPT AS SPECIFICALLY SET FORTH HEREIN, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, ARISING BY LAW OR CUSTOM, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES RESULTING FROM, ARISING OUT OF OR IN ANY WAY RELATED TO THE SALE OR USE OF THE ROTORS. Notwithstanding anything herein contained to the contrary, this warranty shall, for all purposes, be void, and the Company shall have no liability or obligations to Purchaser whatsoever, if the Rotor is (i) improperly installed or not installed by a qualified and certified mechanic, (ii) not subjected to normal use and service, (iii) modified or changed in any way, (iv) damaged as a result of the neglect, negligence or misuse by Purchaser, (v) is damaged as a result of the negligence of, or failure to properly install the Rotor by, the installer, (vi) used for racing or competition purposes or, (vii) damaged as a result of road hazards or accidents. In addition, a failure to install new RayGun Technology™ Brake Pads AT TIME OF THE ROTOR INSTALLATION invalidates this warranty. In any case of warranty claim for a Rotor, you will be required to return BOTH the Brake Pads and Rotor for inspection, and these components will be carefully checked to make sure that they have been used together.

How to proceed with a warranty claim:
A refund, credit or replacement for Warranty Claims shall be offered to Purchaser only, if the following have been satisfied: (a) A Warranty Claim MUST be accompanied by the original sales receipt (no photocopies accepted), or (b) the Company must have received a warranty card, included with the Rotor at the time of purchase, from Purchaser within 30 days of the purchase of the Rotor, or (c) Purchaser must have registered the Rotor, within thirty (30) days of purchase, at [email protected] In addition, Purchaser must provide the Company with proof, such as a work order, that a qualified mechanic installed the Rotor and Brake Pads, whether or not the Rotor and Brake Pads were installed by the store from which Purchaser purchased the Rotor and Brake Pads. Any Warranty Claims by Purchaser must be accompanied by a return of the Rotor and Brake Pads to the Company and include a complete description of the problem. The Rotor and Brake Pads must be returned to the Company freight prepaid.
To enable the motorcycle to be used whilst Purchaser’s Warranty Claim is considered, should Purchaser need to purchase a replacement rotor [and brake pads], this must be done by purchasing a Rotor [and the Brake Pads] from the Company itself. In the event of a successful compensation award, the Company will refund the credit card that Purchaser used to buy the replacement Rotor [and Brake Pads], in full or in part, depending on the nature of the Warranty Claim as described above. B. Motorcycle Disc Brake Pads Warranty:
All RayGun Technology™ motorcycle disk brake pads by (the “Brake Pads”), ARE NOT WARRANTED BY TECH M3, INC. IN ANY MANNER WHATSOEVER, and have no warranty other than the manufacturer warranty as is described on, or set forth in, the packaging containing the Brake Pads. Any and all warranty claims by Purchaser relating to the Brake Pads, MUST be addressed to the manufacturer thereof. WITH RESPECT TO THE RAYGUN TECHNOLOGY™ MOTORCYCLE DISK BRAKE PADS BRAKE PADS BY TECH M3, INC., A CALIFORNIA CORPORATION (“THE COMPANY”) EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY OR WARRANTIES, EXPRESS OR IMPLIED, ARISING BY LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED, TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE COMPANY BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY ACTUAL OR DIRECT DAMAGES, OR INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES, IN EACH SUCH CASE, RESULTING FROM, ARISING OUT OF OR IN ANY WAY RELATED TO THE SALE OR USE OF THE RAY GUN TECHNOLOGY™ BRAKE PADS.
